These Terms constitute a legally binding agreement between you and Geobble. We reserve the right to modify these Terms at any time, and your continued use of the Platform following any changes constitutes acceptance of the updated Terms.

2. Description of Service

Geobble is an AI-powered interactive mapping platform that enables users to:

  • Upload, store, and manage geospatial data
  • Create and share interactive maps and visualizations
  • Use AI-powered tools for data analysis and natural language queries
  • Collaborate with team members through workspaces
  • Organize data through collections, themes, and symbol sets

3. Account Registration and Security

3.1. Account Creation

To use certain features of the Platform, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information to keep it accurate
  • Accept responsibility for all activities that occur under your account

3.2. Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

  • Notify us immediately of any unauthorized use of your account
  • Not share your password or account access with others
  • Take responsibility for all activities conducted through your account

We are not liable for any loss or damage arising from your failure to comply with this section.

3.3. Handles

Your account is identified by a unique handle (e.g., @johndoe) that serves as your permanent identifier on the Platform. You agree that:

  • Handle Uniqueness - Handles are assigned on a first-come, first-served basis, subject to these Terms
  • Handle Permanence - Once set, your handle cannot be changed
  • Handle Ownership - While you have the right to use your handle, Geobble retains ownership of the handle system

Handle Reservation and Reclamation

We reserve the right to reserve, reclaim, or confiscate any handle at any time, with or without notice, for reasons including but not limited to:

  • Platform Routes - Handles that conflict with existing or planned Platform routes and pages (e.g., about, help, privacy, terms, support, explore, etc.)

  • Protected Names - Handles that match or closely resemble:

    • Recognized organization names, trademarks, or brands
    • Government entities and public institutions
    • Public figures and celebrities
    • Known trademarks and service marks

  • Platform Interests - Handles needed for:

    • Platform partnerships and collaborations
    • Premium features or future Platform services
    • Promotional or official Platform accounts
    • Technical or operational requirements

  • Policy Violations - Handles associated with:

    • Terms of Use violations
    • Impersonation or misleading representation
    • Inappropriate or offensive content
    • Fraudulent or deceptive activity

Handle Reclamation Process

If your handle is reclaimed, we will:

  • Provide advance notice when possible (except in cases of immediate policy violations)
  • Allow you to select a new handle
  • Transfer your account data, collections, themes, and resources to the new handle
  • Update your resource URLs accordingly

We are not liable for any damages resulting from handle reclamation or URL changes.

4. Acceptable Use Policy

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You agree NOT to:

4.1. Prohibited Activities

  • Upload or transmit content that is illegal, harmful, threatening, abusive, or defamatory
  • Impersonate any person or entity or misrepresent your affiliation
  • Interfere with or disrupt the Platform or servers connected to the Platform
  • Attempt to gain unauthorized access to any portion of the Platform
  • Use the Platform to transmit malware, viruses, or other harmful code
  • Collect or harvest user data without consent
  • Reverse engineer, decompile, or disassemble any portion of the Platform
  • Use automated systems to access the Platform without express permission

4.2. Data and Content

  • You retain ownership of the geospatial data you upload to the Platform
  • By uploading content, you grant us a license to store, process, and display it solely to provide our services
  • You represent that you have the right to upload and process any data you submit
  • You are responsible for ensuring your data complies with applicable laws and regulations

5. Intellectual Property Rights

5.1. Our Intellectual Property

The Platform and its original content, features, and functionality are owned by Geobble and are protected by international copyright, trademark, and other intellectual property laws. You may not:

  • Modify, copy, distribute, or create derivative works based on the Platform
  • Remove any proprietary notices from the Platform
  • Use our trademarks, logos, or service marks without express permission

5.2. Your Content

You retain ownership of any content you submit to the Platform. You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display your content solely for the purpose of providing our services.

6. AI-Powered Features

The Platform includes AI-powered features such as natural language processing, data extraction, and map generation. By using these features, you agree that:

  • AI-generated outputs are based on your input and available data
  • We are not responsible for the accuracy or completeness of AI-generated content
  • You should review and validate AI-generated results before relying on them
  • AI features are provided "as is" without warranty of any kind

7. Paid Services and Subscriptions

7.1. Pricing and Payment

Certain features of the Platform may require payment. We reserve the right to:

  • Change pricing for any paid services at any time
  • Require payment for services that are currently free
  • Refund or credit fees at our sole discretion

7.2. Subscription Terms

  • Subscriptions automatically renew unless cancelled before the renewal date
  • You may cancel your subscription at any time through your account settings
  • Cancellation takes effect at the end of the current billing period
  • No refunds will be provided for partial or unused subscription periods

8. Termination

You may terminate your account at any time by contacting us or using account deletion features.

8.2. Termination by Us

We reserve the right to suspend or terminate your account at any time, with or without cause, including but not limited to:

  • Violation of these Terms
  • Suspicious or fraudulent activity
  • Extended period of account inactivity

8.3. Effect of Termination

Upon termination:

  • Your right to use the Platform will immediately cease
  • We may delete your account data, subject to our data retention policies
  • All provisions of these Terms that by their nature should survive termination will continue

9. Disclaimers and Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
  • ACCURACY OR RELIABILITY OF DATA, INFORMATION, OR SERVICES
  • AVAILABILITY OR UNINTERRUPTED OPERATION OF THE PLATFORM
  • SECURITY OF DATA TRANSMITTED THROUGH THE PLATFORM

We do not guarantee that the Platform will meet your requirements or that errors will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Geobble SHALL NOT BE LIABLE FOR:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF DATA, REVENUE, PROFITS, OR BUSINESS OPPORTUNITIES
  • DAMAGES RESULTING FROM USE OR INABILITY TO USE THE PLATFORM
  • DAMAGES FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA

Our total liability shall not exceed the amount you paid, if any, for using the Platform during the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Geobble and its affiliates from any claims, damages, losses, liabilities, and expenses arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Data you upload or transmit through the Platform

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which Geobble is established. Any disputes arising from these Terms shall be resolved through:

  1. Negotiation - Good faith attempt to resolve the dispute
  2. Mediation - If negotiation fails, parties agree to non-binding mediation
  3. Arbitration - Final and binding arbitration as the exclusive remedy

13. General Provisions

13.1. Entire Agreement

These Terms constitute the entire agreement between you and Geobble regarding your use of the Platform.

13.2. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force.

13.3. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right.

13.4. Assignment

You may not assign these Terms without our express written consent. We may assign our rights without restriction.

14. Modifications to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on our Platform
  • Updating the "Last Updated" date
  • Sending you a notification through your account if you are a registered user

Your continued use of the Platform after modifications constitutes acceptance of the updated Terms.
